1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of libertyductvent.com and the services provided by Liberty Duct and Vent, LLC ("Liberty Duct," "we," "us"). By browsing the site, requesting a quote, or booking service, you agree to these Terms.

If you do not agree, do not use the site or our services.

2. Service Description

Liberty Duct provides residential and commercial HVAC and air-quality services within a 60-mile radius of Salt Lake City, Utah (postal code 84103). Services include but are not limited to: air duct cleaning, dryer vent cleaning and installation, UV-C light installation, HVAC tune-ups, air duct sealing and repair, sanitizing, mold remediation in ducts, evaporator coil and blower motor cleaning, air purification, whole-home humidifier installation, and furnace filter replacement.

Service availability for any specific city, ZIP code, or property type is subject to confirmation at the time of booking.

3. Quotes & Pricing

• Pre-arrival estimates are provided based on information you supply and are subject to revision once we inspect the property on-site.
• We provide a flat written quote before work begins. The quote becomes the agreed scope and price.
• Additional work outside the quoted scope (discovered conditions, optional add-ons) is performed only with your express written or recorded verbal consent and at the then-quoted rate.
• Prices are quoted in US Dollars (USD) and exclude any applicable Utah state and local sales tax unless stated otherwise.

4. Booking, Scheduling & Cancellation

• Bookings are confirmed by phone, text, email, or written acceptance of an emailed quote.
• Same-day service is offered subject to crew availability.
• Cancellations made at least 4 hours before the scheduled arrival window incur no fee.
• Cancellations made within 4 hours of arrival, or no-show appointments, may incur a dispatch fee of up to $75.
• Liberty Duct reserves the right to reschedule due to weather, equipment failure, prior-job overrun, or safety conditions, with prompt notice to you.

5. Payment Terms

• Payment is due upon completion of work unless otherwise agreed in writing.
• Accepted methods: Visa, MasterCard, American Express, Discover, check, cash, and ACH (commercial accounts).
• Past-due invoices accrue interest at 1.5% per month or the maximum rate permitted by Utah law, whichever is lower, beginning 30 days after the invoice date.
• Returned checks are subject to a $35 fee plus any bank charges.

6. Customer Obligations

• Provide reasonable access to the property, HVAC equipment, and exterior vent caps.
• Disclose known hazards (asbestos, lead, mold, structural damage) prior to service.
• Secure pets and notify us of any individual with respiratory or chemical sensitivities present at the time of service.
• Confirm that you have authority to authorize service at the property (owner, manager, or authorized agent).

7. Satisfaction Guarantee

Liberty Duct stands behind every job with a 100% satisfaction guarantee. If you identify any portion of the agreed scope that was not completed, we will return at no additional charge to address it. The guarantee covers workmanship of the scoped items only and does not extend to:

• Pre-existing equipment failure unrelated to our work.
• Outcomes that depend on third-party equipment or installation we did not perform.
• Future contamination, occupant behavior, or environmental events outside our control.

Guarantee claims must be made within 30 days of service completion.

8. Warranty Disclaimer

EXCEPT FOR THE EXPRESS SATISFACTION GUARANTEE STATED ABOVE, ALL SERVICES AND PARTS ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY UTAH LAW, LIBERTY DUCT DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MANUFACTURER WARRANTIES ON INSTALLED EQUIPMENT ARE PROVIDED BY THE EQUIPMENT MANUFACTURER, NOT BY LIBERTY DUCT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UTAH LAW, LIBERTY DUCT'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THIS WEBSITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $500.

LIBERTY DUCT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or bodily injury caused by Liberty Duct's negligent acts where such limitations are prohibited by law.

10. Indemnification

You agree to indemnify and hold harmless Liberty Duct, its owner, employees, and contractors from any claim, demand, loss, or damage (including reasonable attorney fees) arising out of (a) your breach of these Terms, (b) your violation of law, or (c) your provision of inaccurate information about the property or its condition.

11. Website Use

• You may use this site for lawful purposes only.
• You may not attempt to gain unauthorized access, scrape content for resale, introduce malware, or interfere with other users.
• We may suspend access for users who violate these terms.

12. Intellectual Property

The site, including text, graphics, logos, brand assets, and the "Liberty Duct" name, is the property of Liberty Duct and Vent, LLC and is protected by US copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works from any portion of the site without our prior written consent. Customer-supplied photos remain the property of the customer; we use them only with permission.

13. Governing Law — Utah

These Terms and any dispute arising out of or related to them are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-law principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Salt Lake County, Utah for any non-arbitrable dispute.

14. Dispute Resolution & Arbitration

Step 1 — Informal resolution. Before filing any claim, you agree to contact us at libertyduct.utah@gmail.com and give us 30 days to attempt a good-faith resolution.

Step 2 — Binding arbitration. If unresolved, claims of $10,000 or less may be brought in Utah small-claims court. Larger claims will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Salt Lake County, Utah. Each party bears its own attorney fees unless the arbitrator awards otherwise.

Class action waiver. You and Liberty Duct each agree to bring claims only in an individual capacity. You waive the right to participate in any class, collective, or representative action.

You may opt out of this arbitration agreement within 30 days of first agreeing by emailing libertyduct.utah@gmail.com with the subject line "Arbitration Opt-Out."

15. Changes to These Terms

We may modify these Terms at any time. The "Last updated" date reflects the current version. Material changes will be posted on this page; continued use of the site after changes are posted constitutes acceptance.

16. Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
